Terms and Conditions of Use for Prizes.co.uk (Sites) and Standard Prize Draw Terms (together, the "terms and conditions"). We reserve the right to change these terms and conditions from time to time by changing them on the Sites, although changes will not apply to prize draws already launched at the relevant time. These terms and conditions were last updated on April 18 2012.

INTRODUCTION

These terms and conditions apply to all prize draws available through the Sites (each a Prize Draw) and, together with any applicable specific prize draw terms set out on the individual web landing page for the relevant Prize Draw (Specific Prize Draw Terms) and our privacy & cookies policy (collectively, the Rules), form a legal agreement between you and us and can only be amended with our consent. Our privacy & cookies policy can be found here. By using any of the Sites and/or by participating in any Prize Draw, you are indicating that you agree to be bound by the Rules.
In the event of any conflict or inconsistency between these terms and conditions, and any applicable Specific Prize Draw Terms, the Specific Prize Draw Terms shall prevail, followed by these terms and conditions, but only to the extent necessary to resolve such conflict or inconsistency.
We reserve the right to disable your access to the Sites, at any time, if in our opinion you have violated any of the provisions of these terms and conditions or if any details you provide for the purposes of registering as a user or entering a Prize Draw prove to be false.
Intela deals with so-called opt-in marketing. By participating in Prize Draws on the Sites you can win prizes. The rules for participation and prize draw can be found in these terms and conditions and in the Specific Prize Draw Terms.

ACCESS TO THE SITE

It is your responsibility to ensure your computer system meets all the necessary technical specifications to enable you to access and use the Sites and is compatible with the Sites. It is also your responsibility to ensure that all persons who access the Sites through your Internet connection are aware of these terms and conditions, and that they comply with them.
We cannot guarantee the continuous, uninterrupted or error-free operability of the Sites. Access to the Sites is permitted on a temporary basis and we reserve the right to withdraw, modify or suspend the service we provide on the Sites without notice. We will not be liable to you or any third party for any unavailability, modification, suspension or withdrawal of any of the Sites, or any features, parts or content of the Sites at any time for any period.
We may, from time to time, restrict access to certain features, parts or content of the Sites, or the entire Sites, to users who have registered with us.
You must ensure that any registration details you provide are accurate. If you choose, or you are provided with, a log-on ID (such as a username and password or other identifier) as part of our security procedures, you must treat such information as confidential and must not reveal it to anyone else. You are responsible for all activities that occur under your log-on ID and must notify us immediately of any unauthorised use or other security breach of which you become aware.

HOW THE SITES WORK

The Sites provide a platform for the presentation of leading lead generation offers. You can participate in Prize Draws for a chance to win prizes. In order to participate in Prize Draws you must:

register on the relevant Site;
keep such registration details up-to-date by sending e-mails to us at info@Prizes.co.uk.

PARTICIPATION CONDITIONS

You can only register for one account on any individual Site. The name of the account shall be the email address that you provide when you register your details with us. You must not share access to your registered account with anyone else.
The deadline for participation in each Prize Draw is marked in the Specific Prize Draw Terms. All entries are at the discretion of Intela.
Officers, directors, employees, consultants or agents of Intela or any of its subsidiaries, parent or associated companies, or any of its or their respective suppliers or vendors (including advertising, printing and publicity agencies) or any officers, directors, employees, consultants or agents of any entity connected with any Prize Draw, or relatives of any of the foregoing persons (collectively, Unauthorised Persons) are not permitted to participate in any Prize Draw. For the purposes of these terms and conditions, relative shall include, but not be limited to, a spouse, partner, child or sibling of an Unauthorised Person and any person residing in the same household as an Unauthorised Person. If a non-Qualifying Player (defined in e. below) participates in any Prize Draw, we reserve the right, without prejudice to any other rights under the Rules, to seek the return of any prize. We reserve the right, at our sole discretion, to disqualify any player who cheats or who tampers or attempts to tamper with the entry process for, or the operation of, any Prize Draw, or whose conduct is in breach of the Rules, contrary to the spirit of the Rules or the intention of the relevant Prize Draw, or might, in our reasonable opinion, bring us, any of our affiliates or any of our or their respective brands into disrepute.
The Terms of Use of third parties shall also apply when a third party offers a Prize Draw through the Sites. Intela is not responsible for the proper execution of these prize draws.
Where a prize consists of an event, activity, holiday or the performance of a service, the winner is solely responsible for complying with any booking or other conditions or instructions of the relevant third party provider or organiser and must be able to comply with any restrictions as to dates and times in relation to the prize (which may not be re-scheduled) and any other eligibility restrictions imposed by the relevant third party provider or organiser. The contract in relation to any such event, activity, holiday or service will be directly between the winner and the relevant third party provider or organiser and we will not be a party to that contract or have any liability in relation to its performance or non-performance, which shall be the sole responsibility of the relevant third party provider or organiser. We will not provide any form of insurance, including without limitation any public liability or cancellation insurance, in respect of any prize consisting of an event, activity, holiday or service.
To be eligible to participate in any Prize Draw, you must:

be legally entitled to use our services in accordance with these terms and conditions;
if the Prize Draw is specifically intended for players who are residents of and/or located in a particular country as stated in the applicable Specific Prize Draw Terms, be a resident of and/or located in the relevant country;
have successfully completed registration on the relevant Site in accordance with these terms and conditions;
satisfy any other eligibility criteria set out in these terms and conditions and in the applicable Specific Prize Draw Terms;
be at least 18 years old (or if you are 16 or 17 years old, have obtained the permission from a parent or legal guardian); and
not be an Unauthorised Person (as defined in clause 4c above), (a Qualifying Player).

If you win a Prize Draw on any of the Sites, you grant us the right, but not the obligation, to use and publish your name and your home county and/or country of your postal address on the Sites and in printed documents, or any other media in connection with the Sites. If you accept a prize from us, you give your consent to Intela and its selected third party advertising and/or promotional agencies to use your name and home county and/or country and likenesses for advertising and promotional purposes without additional compensation or payment of any kind unless required by law. You agree to send us a picture of yourself and to use it in accordance with this clause 4 g.
Intela reserves the right to disqualify a participant in a Prize Draw if we are of the opinion that such participant circumvents the admission process or otherwise violates the Rules.

TERMINATION

You can terminate your registered account with us by contacting our customer service team by clicking here or by sending a letter to Intela, Suite 305, Princess House, London W1W 8EA. Such a request to terminate your registration with us shall form an opt-out regarding the receipt of Prize Draw Communications (as defined in clause 19d below) about Prize Draws from us. Please note that if you have entered any offer, prize draw or other promotion operated by any third party, such third party may still contact you in accordance with any terms that you may have entered into with them. We advise that you contact the relevant third party directly if you are contacted by it and/or have any queries in relation to any offer, prize draw and/or promotion operated by such third party. We are not responsible for any third party offer, prize draw and/or promotion that feature on the Sites.
For the avoidance of doubt, we point out that if you participate in an offer, prize draw and/or other promotion from a third party that features on the Sites, you enter into such offer, prize draw and/or promotion with the relevant third party. Therefore you cannot terminate your participation in an offer, prize draw and/or other promotion from a third party except as determined in the terms and conditions applicable to such third party offer, prize draw and/or promotion.
If you win a prize you shall be notified via an email to the email address that you provided at registration (or, if you have updated your registration details since registration, the most recent email address you have provided to us). It is your responsibility to ensure that this information remains up-to-date and Intela does not accept any responsibility if you provide out-of-date or otherwise incorrect contact details.

PRIZES AND WINNERS

Qualifying Players who win a prize as the result of any Prize Draw must accept the relevant prize "as is" and there is no right to a cash alternative unless we, in our sole discretion, elect to offer such a cash alternative (which may be less than the full value of the prize). We reserve the right, at any time, to substitute any prize with one or more prizes (other than a cash alternative) of substantially equivalent value. We may do this, in particular, if it is impractical or unduly costly to deliver a particular prize to the winner's geographical location.
Prizes will be drawn at random and, provided all players must be Qualifying Players, no favouritism will be shown in terms of gender, age, geographic location, length of time as a Qualifying Player, or any other factor.

RECEIPT OF PRIZES RULES OF DELIVERY

If you win a prize, it will be sent to the address specified by you at the time you registered an account on the relevant Site (or if you have updated your registration details since registration, the most recent address that you have provided us with), or the address you provided when you entered the relevant Prize Draw. It is your responsibility to provide the correct address.
We are not responsible for any prize delivered to an incorrect address, even where this is the mistake of whoever delivers the prize and/or if the prize is stolen before it is delivered to you. We reserve the right to draw another winner in place of the original winner or to forfeit the prize altogether without liability to the winner.
We reserve the right not to award a prize or to seek the return of any prize awarded in the event that the winner is not entitled to receive such prize in accordance with applicable law (provided that the winner is solely responsible for ensuring that s/he is entitled to receive any prize) or if we have cause to disqualify the winner in accordance with these terms and conditions.
Any entitlement to a prize is non-transferable.
The winner is solely responsible for the payment of any applicable tax in relation to the relevant prize and for any costs associated with the prize or its use, including without limitation the cost of complying with any requirements of applicable local law. Examples of such associated costs include, but are not limited to, if the prize consists of a motor vehicle, in relation to vehicle registration, motor insurance and driving licence or, if the prize consists of foreign travel, in relation to passport, visa and travel insurance requirements or, in relation to prizes that are location-specific (for example, an event, activity or holiday), the cost of travel to and from the relevant location (unless the Prize is expressed to include travel or consists of a flight, train journey or sea voyage, in which case the winner is responsible for travel to and from the point of embarkation).
If we believe, in our sole discretion, that any address you have provided has received multiple prizes, at all times we have the right to refuse future delivery of prizes to such address where we suspect fraud.
In cases where we deliver the incorrect prize to a winner, we shall take reasonable efforts (but will not be obliged) to deliver the correct prize to such winner.
If a prize is found to be defective, we advise the winner to consult the relevant information that is provided by the manufacturer of that prize and contact such manufacturer. Intela is not responsible for the repair or replacement of any defective prize. Please contact the manufacturer if you have any questions about damaged or defective prizes that we have delivered to you. In cases where you do not know who manufactured the relevant prize, we may provide you with the contact information of the relevant manufacturer.
Where, in relation to a prize, we make use of any third party name or trade mark, these are proprietary to the relevant third party. No licence, affiliation, sponsorship or endorsement is claimed or should be inferred from the use of these names or trade marks or the use of any photograph of a prize. Any photograph used to promote a prize is for illustrative purposes only and the actual prize may differ from the item shown in the photograph, including without limitation as to make, model, specification, colour, finish, packaging and other features.
Our offering of a particular prize implies no affiliation on our part with or sponsorship or endorsement of the relevant third party manufacturer, supplier, provider or organiser.
The winner is solely responsible for all use made of the prize. Except as expressly provided in these terms and conditions, no representations, warranties, conditions or other terms are made, given or accepted by us and no other terms shall apply, as between us and any person, in relation to any prize, including without limitation any terms as to suitability, reliability, satisfactory quality or fitness for purpose, or any other implied terms, all of which we exclude to the maximum extent permitted by law.

WHAT YOU ARE NOT ALLOWED TO DO

Any unauthorised use or access ("hacking") to the Sites is illegal and punishable by law. The slightest violation of the law will be sufficient incentive for us to prosecute the offender to the fullest extent of the law.
You must only use the Sites and anything available from the Sites for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our affiliates.
All rights granted to you under these terms and conditions will terminate immediately in the event that you are in breach of any of them.
CAUTION: ANY ATTEMPT BY A PARTICIPANT AND/OR ANY OTHER PERSON OR PERSONS TO DELIBERATELY DAMAGE ANY OF THE SITES AND/OR UNDERMINES THE LEGITIMATE OPERATION OF THE SITES CAN BE AN INFRINGEMENT OF CRIMINAL AND CIVIL LAWS AND IF SUCH AN ATTEMPT BE TAKEN INTELA RESERVES THE RIGHT TO RECOVER DAMAGES FROM ANY SUCH PARTICIPANT AND/OR PERSON OR PERSONS TO THE EXTENT PERMITTED BY LAW.
After you have received a prize, if we find that you have done so fraudulently, we reserve the right to institute legal action against the you.

CONTENT AND LINKS TO THIRD PARTY WEBSITES

We may change the format and content of the Sites from time to time. You agree that your use of the Sites is on an 'as is' and 'as available' basis at your sole risk.
Whilst we try to make sure that all information contained on the Sites is correct, it is not intended to amount to authority or advice on which reliance should be placed. You should check with us or the relevant information source before acting on any such information.
We make no representations or warranties, explicit or implied, as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose or originality of any content on the Sites and, to the fullest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded. To the fullest extent permitted by law, we accept no liability for any loss or damage of any kind incurred as a result of you or anyone else using the Sites or relying on any of its content.
We cannot and do not guarantee that any content on the Sites will be free from infection by viruses and/or other code which has contaminating or destructive properties. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to safety and reliability of content.
The Sites may, from time to time, include links to external sites. We have no control over the content of these sites and/or anything provided by them and do not guarantee that they will be continuously available. We accept no responsibility for these sites or any loss or damage that may arise from your use of them. The fact that we include links to such external sites does not imply any endorsement of or association with those operators.
We are not responsible for the terms and conditions of any of the affiliated websites or partner offers, prize draws and/or other promotions that are operated and run by third parties which feature on the Sites. We attempt to screen such offers, prize draws and/or other promotions to provide the best possible experience for you. We are also, for the avoidance of doubt, not responsible for any resulting charges and/or contracts entered into incurred between you and any third party that provides offers, prize draws and/or other promotions which feature on the Sites. We therefore recommend that you carefully read all the relevant terms and conditions that relate to third party offers, prize draws and/or promotions, together with the relevant privacy policy and billing information for each offer.

OUR LIABILITY TO YOU

Except that we do not exclude or limit our liability for personal injury or death caused by our negligence or for fraudulent misrepresentation or any other liability that may not, by law, be limited or excluded, we accept no liability in relation to your participation (or inability to participate) in any Prize Draw, including without limitation any use made by you of (or inability to use) any prize, to the maximum extent permitted by law. Subject to this, in no event shall we be liable to you for any business losses or loss of opportunity. Any liability we do have for losses you suffer is strictly limited to losses that were reasonably foreseeable and in any case limited to the greater of a) the value of the prize or b)£250.
If any Prize Draw cannot be executed as planned, including due to any technical problems or circumstances beyond our control, we shall incur no liability and no payment or prize of any kind will be awarded.

ALTERATION AND TERMINATION OF PRIZE DRAWS

We reserve the right to alter, discontinue or terminate any Prize Draw, or any aspect of it, at any time, with or without notice, for any reason whatsoever, including without limitation if there has been any printing, production, distribution or other error in the preparation for or conduct of any Prize Draw affecting the result of the Prize Draw or the number of participants or the value of claims.
The Rules may be modified by us at any time by posting the modified terms on the relevant page(s) of the Sites. We recommend you revisit these terms and conditions regularly. By your continued participation in the relevant Prize Draw, you accept any such modified terms.

INTELLECTUAL PROPERTY

We are the owner or licensee of all intellectual property rights in any content of the Sites (including images, logos, trade marks, text, graphics, software, photographs, videos and/or sound).
Except as expressly set out here, nothing in these terms and conditions gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the Sites.
You may only use the Sites and the content on them for your personal (and never commercial) purposes. You may download, print and share with friends the content you select for such use. No right, title or interest in any downloaded content or material is transferred to you as a result of such downloading printing and/or sharing with friends. You may not modify, reformat, copy, reproduce, display, distribute, transmit, publish, license, sell, rent, transfer and/or create derivative works of any paper or digital copies of any material you have printed off or downloaded in any way from the Sites. You may not mirror or copy the home page of the Sites or any other page from the Sites onto another website, and you may not make "deep links" to the site. You may not use any robot, scraper or other automated means to access the Site. You are prohibited from using any of the trademarks or logos appearing on the Sites, without express written permission of the owner of the trademark, except as permitted by applicable law. You may only use the Sites and the content on them for your personal (and never commercial) purposes. In the event that you print off, copy or store pages from the Sites (only as permitted by these terms and conditions), you must ensure that copyright, trade mark or other intellectual property right notices contained in the original content are reproduced. Our status (and that of our identified contributors) as the authors of material on our Sites must always be acknowledged
Intellectual property infringement. It is the policy of Intela to quickly respond to, and take legal action against, those who infringe our intellectual property rights.
If you print off, copy, download any part of the Sites in breach of these terms and conditions, your right to use the Sites will terminate immediately and you must, at our option, return or destroy any copies of materials you have made.

GENEAL PROVISIONS

Each provision of these terms and conditions shall be construed, if possible, to be valid and enforceable as much as possible. If any provision of these terms and conditions is interpreted to be invalid, illegal or otherwise unenforceable by a court of competent jurisdiction then such provision, where possible, shall be considered separately from these terms and conditions, and all other provisions shall remain effective in full force.
These terms and conditions are governed by English law, and you agree that any dispute between us regarding them and/or the Sites and/or any Prize Draw will only be dealt with by the English courts. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.

NO WAIVER

No failure and/or delay by us in enforcing any term of the Rules against you shall constitute a waiver of that or any other term in the Rules, and also no failure and/or delay by us in enforcing any term of the Rules against you shall constitute a waiver of any preceding or subsequent breach of that or any other term in the Rules.
Omission or delay by us in exercising any of our rights under the Rules shall not be deemed a waiver of that or any other right in the Rules. In cases where we do waive any of our rights regarding a breach by you of the Rules, such waiver shall not constitute a waiver of any preceding or subsequent breach of that or any other term in the Rules.

CORRECTION OF ERRORS AND INACCURACIES

The content on the Sites may contain typographical or other errors or inaccuracies and may not be accurate or up-to-date. Subject to the next sentence, Intela reserves the right to correct any errors, inaccuracies or omissions or otherwise correct and/or update the content of the Sites at any time, without prior notice. Please note that changes to the Rules will not apply to Prize Draws already launched at the relevant time. Intela does not guarantee that any errors, inaccuracies or omissions will be corrected.

REGISTRATION ON THE SITES

You should register on each Site individually if you want to enter Prize Draws on it. Please note that the Sites are not connected with each other. You are not permitted to register more than once on an individual Site.
Only unique addresses, telephone numbers, and IP addresses can be registered with us. We do this to ensure qualitative leads for our advertisers. All registered accounts on the Sites that share the same address, telephone number, and/or IP address as someone else who has registered on the Sites will be suspended.
You must not use someone else's name or information to receive prizes from the Sites. For the avoidance of doubt, no-one may become a member of the Sites on behalf of someone else, or participate in Prize Draws using someone else's registered account.
Each user is solely responsible for maintaining the security of his or her registration details. You should not share your registration details with anyone else and you are solely responsible for keeping these confidential. We are not liable for any losses and/or damage you suffer as a result of a third party accessing your account.
If you have your access to any of the Sites suspended then you are not permitted to register on another of our Sites.

CUSTOMER SERVICE

Contacting Customer Support/Customer Service. Because of the volume of questions for the customer service department, we do not offer telephone support. Any questions, comments and complaints/concerns should be directed to us only after reading these terms and conditions since many answers to frequently asked questions can be found here.

We aim to respond within two working days to questions that you ask in emails sent to our email address specified in clause 17 b.
In order to preserve the security of your registration details and to promote the efficiency of the customer service that we provide you with, you should only contact us with the email address you have registered on the relevant Site.
We reserve the right to block your email address in our sole discretion and therefore not respond to emails sent from it.

HOW CAN YOU ENTER PRIZE DRAWS?

You can participate in certain Prize Draws which are featured on several or all of the Sites, rather than solely one of them. Where such Prize Draws take place, all entrants will stand the same chance of winning the prize(s).
Winners are chosen at random 7 days after the deadline for participation in the relevant Prize Draw has passed unless the Specific Prize Draw Terms state otherwise.
There is no minimum or maximum number of participants for any particular Prize Draw. The odds of winning any Prize Draw depends on the total number of entrants for that Prize Draw. Unless otherwise indicated in the applicable Specific Prize Draw Terms, entry into each Prize Draw may be used only once.
The particular form of Prize Draw will be described, and full details set out, in the communications (such as emails, computer pop-ups and letters) we issue to tell you about each Prize Draw (each a Prize Draw Communication) and/or on the individual Site's landing page for the relevant Prize Draw.
The period of time during which each Prize Draw will run (Prize Draw Period) and the date on which winners will be contacted will be specified in the applicable Specific Prize Draw Terms. Each Prize Draw will automatically close at the deadline for participation in it, at which point no further participation in that Prize Draw will be possible. Where no deadline is specified, the relevant Prize Draw will end when it is discontinued on the relevant Site(s).
Unless otherwise indicated in the Prize Draw Communication, it is intended for the addressed recipient or category of recipient only and cannot be transferred. If you are not the intended recipient or within the intended category of recipient, then the offer is null and void.
Participation in any Prize Draw is voluntary. You have the choice to decline to participate in any Prize Draw by simply ignoring the relevant Prize Draw Communication.
To participate in a Prize Draw, you should follow the instructions set out in the relevant Prize Draw Communication, on the individual Site landing page for that Prize Draw and, where appropriate, the applicable Specific Prize Draw Terms.

GENERAL

If you win a prize you will be informed via telephone, e-mail or letter. If you do not respond to us in accordance with such telephone call, email or letter within 7 days, you will lose your opportunity to win that prize. Intela will then select another participant to win the prize at random. If you participate in a Prize Draw you accept to receive Prize Draw Communications as specified in the relevant Specific Prize Draw Terms. Such Prize Draw Communications will only be sent by Intela on its own behalf or its sponsors. Your data is always stored and used in strict accordance with our privacy & cookies policy. Please read our privacy & cookies policy carefully so you understand how we use your information and you understand your rights.
The Sites are registered in accordance with English privacy law and we only carry out opt-in permission marketing.
The names of the winners of particular Prize Draws are available from Intela. If you would like to receive such information, please write to Suite 305, Princess House, London W1W 8EA and include a self-addressed and stamped envelope.
You may not assign or transfer any or all of your rights or obligations under the Rules.
No third party shall have a right to enforce the Rules against us.
Failure by us to enforce a right under the Rules does not result in waiver of such right.
If any part of the Rules is found to be unenforceable as a matter of law, all other parts of the Rules shall be unaffected and shall remain in force.
Our determination and decision on all matters will be final and no correspondence will be entered into. Any dispute or situation not covered by the Rules will be resolved by our management in a manner it deems to be the fairest to all concerned and, subject to the following sentence, that decision shall be final and binding on all players.
If these terms and conditions or any applicable Specific Prize Draw Terms are translated into a language other than English, then the English version shall prevail where there is any inconsistency.
